The Army's voluntary decision at Fort Ord came about as a result of a lawsuit

Army to Complete RI/FS for OE at Fort Ord

Facing a likely adverse ruling in a federal courtroom, the Army has voluntarily agreed to clean up ordnance and explosives (OE) at the former Fort Ord Army Base (BRAC 1991) pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as the Superfund law. In doing so, the Army avoided a judge's decision that might have set a precedent for OE cleanup nationwide.

The Army's voluntary decision at Fort Ord came about as a result of a lawsuit, Fort Ord Toxics Project v. U.S. Army, filed in the U.S. District Court for the Northern District of California. The suit charged that the Army has an obligation to treat the cleanup of OE under the same CERCLA guidelines used for soil and groundwater contamination.

 A second lawsuit was filed by the Monterey Bay Unified Air Pollution Control District in response to the Army's prescribed burns of suspected OE sites at Fort Ord. Heavy smoke, some of which filtered into the adjacent Salinas Valley, caused widespread community concern. This second lawsuit was settled when the Army and District agreed to a more restrictive burn plan.
